Agreement - These Terms and Conditions together with any booking confirmation, privacy policy, and refund policy.
Booking - An order for skip bin hire services submitted by a Customer through the Website.
Customer / You - Any individual or entity that accesses the Website, creates an account, or places a Booking.
Genie Skip Bins - Global Genie Marketing and IT Services Pty Ltd, trading as Genie Skip Bins, acting as an online booking platform and agent.
Supplier - The independent, locally-based skip bin hire operator engaged to fulfil a Booking in a given service area.
Services - The skip bin hire and waste collection services performed by a Supplier as arranged through the Website.
Platform - The Website, mobile applications, and associated digital tools operated by Genie Skip Bins.
Booking Fee - The payment collected by Genie Skip Bins upon confirmation of a Booking, inclusive of GST.
GST - Goods and Services Tax.
Force Majeure - Any event beyond the reasonable control of a party (refer to Section 16 for full definition).
Prohibited Waste - Waste types that must not be placed into any skip bin (refer to Section 11 for the full list).
Hire Period - The agreed duration for which a skip bin is placed at the Customer's nominated location.
Working Day - Monday to Friday, excluding Australian public holidays.
2.1 Genie Skip Bins operates as an online booking platform and booking agent. We do not directly own or operate skip bins. We connect Customers with qualified local Suppliers across Australia who fulfil the hired services.
2.2 By accepting a Booking, each Supplier has authorised Genie Skip Bins to enter into service contracts on their behalf and to collect payment for services arranged through the Platform.
2.3 Genie Skip Bins receives a platform fee or commission from Suppliers for bookings made through the Website.
2.4 Genie Skip Bins is not responsible for the physical quality, timeliness, or performance of the skip bin services, except where expressly stated in this Agreement or required by law. Any service-specific
disputes must be raised with the Supplier. We will, however, use reasonable endeavours to assist in resolving disputes.
2.5 Genie Skip Bins recommends Suppliers based on location, availability, waste type, and pricing. The recommendation does not constitute an endorsement of any Supplier's quality or compliance with
applicable laws.
3.1 You must be at least 18 years of age to place a Booking or create an account on the Website. By using the Website, you represent and warrant that you satisfy this requirement.
3.2 If you are placing a Booking on behalf of a company, organisation, or another individual, you confirm that you have the authority to bind that entity to this Agreement.
3.3 You must provide accurate, current, and complete information when creating an account or submitting a Booking. Genie Skip Bins reserves the right to suspend or terminate your account if any
information is found to be inaccurate or misleading.
3.4 You are responsible for maintaining the confidentiality of your account credentials. Genie Skip Bins is not liable for any loss or damage resulting from unauthorised access to your account.
4.1 To place a Booking, you must:
4.2 A Booking constitutes an offer by you to enter into a contract for skip bin hire services with the Supplier assigned to your location. A binding contract is formed upon receipt of a Booking
Confirmation email from Genie Skip Bins.
4.3 Genie Skip Bins reserves the right to decline any Booking at its sole discretion, including where Supplier availability is not confirmed, without incurring any liability to you beyond a full refund of the
Booking Fee paid.
4.4 You will receive a Booking Confirmation detailing the assigned Supplier, bin size, waste type, delivery address, hire period, and total cost. Please review the Booking Confirmation carefully and
contact us promptly if any details are incorrect.
4.5 Prices displayed on the Website are based on waste type, skip bin size and location. Genie Skip Bins reserves the right to adjust quoted prices if incorrect information was submitted.
5.1 Pricing All prices displayed on the Website are in Australian dollars (AUD) and include GST unless otherwise stated. Prices include standard delivery and collection of the skip bin for the agreed Hire Period.
5.2 Payment Full payment of the Booking Fee is required at the time of submitting your Booking. Payment is accepted via credit card, debit card, and other methods displayed at checkout. Your card details are processed securely through our payment gateway provider.
5.3 Additional Charges — Payable Directly to the Supplier.
The following additional charges may be levied by the Supplier directly and are not included in the
Booking Fee:
Excess Weight Surcharge - Charged per tonne over the agreed weight limit. Rate set by individual Supplier (approx. $275/tonne + GST as a guide).
Engineered Stone Surcharge - Any bin containing engineered stone material is subject to a surcharge (approx. $350/tonne + GST).
Extended Hire - Additional daily or weekly rate applies if the bin is retained beyond the agreed Hire Period.
Contaminated Load - Where prohibited waste is found in the bin, the Supplier may charge additional disposal, cleaning, or sorting fees.
Council Permit - Where a skip bin must be placed on public property (e.g., a road or footpath), you are responsible for obtaining and paying for any required council permit.
Mattresses / Tyres - These items may attract additional disposal surcharges. Confirm with your Supplier at the time of booking. Difficulty Surcharge Delivery to locations with limited or difficult access (narrow lanes, steep driveways, etc.) may incur additional charges at the Supplier's discretion.
5.4 Genie Skip Bins accepts no liability for additional charges levied by Suppliers. You are responsible for paying all such charges directly to the Supplier.
5.5 In the event of a failed payment, Genie Skip Bins reserves the right to cancel the Booking immediately. Reinstating a cancelled Booking is subject to Supplier availability and may incur
additional processing fees.
6.1 The Supplier will use reasonable endeavours to deliver the skip bin on the agreed delivery date. Neither Genie Skip Bins nor the Supplier guarantees a specific delivery time within the agreed day.
6.2 If the Supplier is unable to deliver on the agreed date due to circumstances beyond their control, they will notify you and arrange an alternative date as soon as practicable. You are not entitled to
cancel a Booking solely due to a delivery delay unless the delay exceeds 3 Working Days beyond the agreed date.
6.3 Access and Site Conditions
You are solely responsible for:
Ensuring safe, clear, and suitable vehicle access to the delivery site;
Removing any obstacles that would prevent delivery or collection of the bin;
Ensuring the ground surface is adequate to support the weight of the bin and the delivery truck;
Protecting any sensitive surfaces (driveways, pavers, soft ground) — Genie Skip Bins and the
Supplier accept no liability for any surface damage;
Compliance with any Body Corporate, strata, or landlord requirements for placement of the bin on the property.
6.4 If the Supplier is unable to access the delivery site due to conditions created by you or circumstances you could have reasonably foreseen, a redelivery fee may apply.
6.5 The skip bin must not be moved from the agreed delivery location without prior written consent from the Supplier.
6.6 Council Permits If the bin is to be placed on a public road, footpath, nature strip, or any other public land, you are responsible for obtaining the relevant council or local government permit before delivery. Genie Skip Bins can provide guidance on contacting your local council but accepts no responsibility for permit compliance.
7.1 The standard Hire Period is as specified in your Booking Confirmation (typically 3–7 days). If no Hire Period is specified, the standard hire period is 7 calendar days from the date of delivery.
7.2 If you require the bin for longer than the agreed Hire Period, you must contact Genie Skip Bins or the Supplier prior to the expiry of the agreed period. Extended hire rates will apply from the original
collection date.
7.3 If the bin is filled before the scheduled collection date, you may request an early collection by contacting Genie Skip Bins. Early collection is subject to Supplier availability and is not guaranteed.
7.4 The Supplier reserves the right to collect the bin at any time after the agreed Hire Period expires. Genie Skip Bins accepts no liability for any inconvenience this may cause.
8.1 Customer Cancellations
You may cancel a confirmed Booking subject to the following conditions:
Requests to vary a confirmed Booking (e.g., bin size, waste type, delivery date) must be submitted at least 2 Working Days before the scheduled delivery. Variations are subject to Supplier availability and
may be subject to price adjustments and an Administration Fee.
8.3 Cancellation by Genie Skip Bins or the Supplier If Genie Skip Bins or the Supplier must cancel a confirmed Booking, you will be notified as soon as practicable. Genie Skip Bins will make reasonable efforts to secure an alternative Supplier. If no alternative is available, a full refund of the Booking Fee will be issued within 5 Working Days.
8.4 Refunds for Unsatisfactory Service
A refund may be issued in the following circumstances:
8.5 All refunds will be returned to the original payment method used at the time of booking. Processing times are subject to your bank or card provider (typically 5–10 business days).
9.1 While the skip bin is in your possession, you are responsible for its safe and lawful use. You must not:
Light fires in or near the bin;
Overfill the bin beyond the fill line marked on the sides (all contents must be contained within
the bin walls with nothing protruding over the top);
Place hazardous, liquid, or Prohibited Waste into the bin (refer to Section 11);
Move the bin without the Supplier's prior written consent;
Allow third parties to dispose of waste in the bin without your authorisation;
Permit children to play in or near the bin;
Allow liquids, including rainwater accumulation, to accumulate within the bin.
9.2 You are liable for any damage to the skip bin (beyond fair wear and tear) that occurs while the bin is in your possession. The Supplier may charge you for repair or replacement costs.
9.3 Overfilled bins may be refused collection by the Supplier. In such cases, you will be required to remove excess waste before collection proceeds. Re-delivery fees and additional charges may apply.
Genie Skip Bins offers the following main waste type categories. It is your responsibility to select the correct waste type for your Booking. Incorrect waste type selection may result in additional charges or
refusal of collection.

11.1 The following items must NEVER be placed into any skip bin booked through Genie Skip Bins, regardless of waste type selected. Placing Prohibited Waste in a bin is a serious breach of this
Agreement and may constitute a breach of applicable environmental and safety legislation:

11.2 If Prohibited Waste is discovered in your bin at the time of collection, the Supplier reserves the right to: (a) refuse to collect the bin; (b) levy additional sorting, disposal, and cleaning fees; and/or (c)
report the matter to the relevant environmental or regulatory authority. All costs associated with the disposal of Prohibited Waste are your sole responsibility.
12.1 Risk of loss or damage to the skip bin passes to you upon delivery to your nominated address and remains with you until the Supplier collects the bin.
12.2 You will be liable to the Supplier for any damage to the skip bin (beyond normal wear and tear) occurring during the Hire Period, including but not limited to: structural damage, damage caused by
fire, chemical corrosion, or impact.
12.3 You should ensure that the placement area is free of underground utilities, pipes, or cables. Genie Skip Bins and the Supplier accept no liability for damage to underground services resulting
from delivery or collection of the bin.
13.1 You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of any third party.
13.2 You must not: (a) use any automated means to access or scrape the Website; (b) introduce viruses or other harmful code; (c) attempt to gain unauthorised access to any part of the Website's
systems; or (d) use the Website in a fraudulent or deceptive manner.
13.3 Copyright - All content on the Website, including text, images, logos, and design, is owned by or licensed to Genie Skip Bins and is protected by Australian copyright law. You may not copy, reproduce,
distribute, or publish any content without prior written consent from Genie Skip Bins.
13.4 Third-Party Links - The Website may contain links to third-party websites for your convenience. Genie Skip Bins does not control, endorse, or accept responsibility for the content of any linked third-party website. Accessing any linked site is at your own risk.
14.1 Genie Skip Bins collects, stores, and uses your personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and our Privacy Policy available at
www.genieskipbins.com.au/privacy-policy.
14.2 By placing a Booking, you authorise Genie Skip Bins to:
14.3 We do not sell your personal information to third parties. Genie Skip Bins will only disclose personal information where required by law or as described in the Privacy Policy.
15.1 To the maximum extent permitted by Australian law, Genie Skip Bins expressly excludes all warranties, representations, and conditions (whether express, implied, statutory, or otherwise)
regarding the Website and the Services, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
15.2 Genie Skip Bins' aggregate liability to you for any claim arising out of or in connection with this Agreement is limited to the total Booking Fee paid by you for the specific Booking to which the claim
relates.
15.3 To the fullest extent permitted by law, Genie Skip Bins will not be liable for:
15.4 Consumer Law
Nothing in this Agreement is intended to exclude, restrict, or modify any consumer guarantees or rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable state or territory legislation that cannot be excluded, restricted, or modified by agreement.
16.1 Neither Genie Skip Bins nor any Supplier will be liable for any failure or delay in performing any obligation under this Agreement where such failure or delay results directly or indirectly from any
cause beyond the reasonable control of the affected party, including without limitation:
16.2 The affected party must notify the other party as soon as practicable of the Force Majeure event and its expected duration. If the Force Majeure event continues for more than 14 consecutive days,
either party may terminate the Booking by written notice, with a full refund of the Booking Fee payable to you.
You agree to indemnify, defend, and hold harmless Genie Skip Bins, Global Genie Pty Ltd, their directors, officers, employees, agents, and Suppliers from and against any and all claims, damages,
losses, liabilities, penalties, fines, costs, and expenses (including reasonable legal fees) arising out of or relating to:
18.1 Suppliers are independent contractors. They are not employees, partners, or agents of Genie Skip Bins. Genie Skip Bins does not supervise or control the day-to-day operations of any Supplier.
18.2 Each Supplier is independently responsible for holding all required licences, permits, and insurance to conduct skip bin hire operations in their jurisdiction.
18.3 Any dispute regarding the quality, timeliness, or performance of services is between you and the Supplier. Genie Skip Bins will use reasonable endeavours to facilitate resolution but is not obliged to adjudicate or financially compensate for Supplier performance failures beyond the refund provisions in Section 8.
19.1 Genie Skip Bins reserves the right to amend, update, or replace these Terms and Conditions at any time. Updated terms will be posted on the Website with a revised effective date.
19.2 Your continued use of the Website or placement of a new Booking after the posting of updated terms constitutes your acceptance of those terms. If you do not agree to the revised terms, you must
cease using the Website.
19.3 Bookings confirmed prior to an amendment will be governed by the terms in effect at the time of confirmation, except where required otherwise by law.
20.1 Governing Law - This Agreement is governed by the laws of Australia. You agree to submit to the exclusive jurisdiction of Australian courts.
20.2 Severability - If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.
20.3 Waiver - Failure by Genie Skip Bins to enforce any right or provision of this Agreement does not constitute a waiver of that right or provision. Any waiver must be made expressly and in writing.
20.4 Entire Agreement - This Agreement, together with the Privacy Policy, Refund Policy, and Booking Confirmation, constitutes the entire agreement between you and Genie Skip Bins with respect to your use of the Website and the Services and supersedes all prior agreements.
20.5 Assignment - You may not assign or transfer any of your rights or obligations under this Agreement without the prior written consent of Genie Skip Bins. Genie Skip Bins may assign this Agreement to any successor entity without your consent.
20.6 No Partnership - Nothing in this Agreement creates a partnership, joint venture, employment, or agency relationship between you and Genie Skip Bins.
20.7 Dispute Resolution
In the event of a dispute, we encourage you to contact us first at ved@globalgenie.com.au. If a dispute cannot be resolved informally, both parties agree to engage in good-faith mediation before commencing legal proceedings.
